Please read these terms and conditions carefully before booking your services with us.

1. Acceptance of Terms

By accessing our website, booking our travel packages, or employing our services, you agree to comply with and be bound by the following Terms & Conditions. These terms govern the relationship between Cephill Tours & Travels ("the Company", "we", "us", or "our") and the traveler ("the Client", "you", or "your").

If you disagree with any part of these terms, please do not use our website or book our services.

2. Booking & Confirmation

To reserve a tour package or travel service with Cephill Tours & Travels, the booking process must be completed online, via WhatsApp, or through an authorized booking agent. The following rules apply:

  • Inquiry & Details: You must provide accurate traveler information, including passport names, dietary needs, and health details.
  • Reservation Status: A booking is considered "requested" when submitted and is only confirmed once we issue a formal confirmation invoice and receive the required deposit.
  • Minors: Bookings made by persons under the age of 18 must have the consent of a parent or guardian.

3. Rates & Payments

All prices quoted are in Kenyan Shillings (KSh) or United States Dollars (USD), unless otherwise stated. Pricing for tour packages covers only the inclusions explicitly specified in the package details.

  • Deposits: A non-refundable deposit of 30% of the total tour cost is required to secure any local tour booking, and up to 50% for international packages.
  • Balance Payment: The remaining balance must be cleared at least 7 days before the tour commencement date for local safaris and excursions, and 30 days before for international bookings.
  • Late Payment: Failure to pay the balance within the designated timeframe reserves the Company the right to cancel the booking and retain the deposit.

4. Cancellations & Refund Policies

Should you wish to cancel your booking, you must submit a written cancellation request via email. Cancellation fees are calculated from the day we receive written notification:

  • Cancellations made more than 14 days prior to departure: Full refund of the balance paid, minus the non-refundable deposit and a nominal 5% administrative fee.
  • Cancellations made between 7 and 14 days prior to departure: Refund of 50% of the total booking cost.
  • Cancellations made less than 7 days prior to departure: No refund will be issued.

Cancellations by Cephill Tours: We reserve the right to cancel a tour due to conditions beyond our control (e.g., severe weather, safety threats, vehicle breakdown). In such instances, we will offer alternative dates, an alternative package of equal value, or a full refund of all payments made.

5. Travel Insurance & Responsibility

Travelers are strongly advised to purchase comprehensive travel insurance upon booking. The policy should ideally cover cancellation costs, personal accidents, medical expenses, emergency evacuation, loss of luggage, and personal liability.

It is the Client's responsibility to ensure they possess valid passports, visas, health vaccinations (e.g. Yellow Fever certificates), and any other entry permits required for their destination.

6. Force Majeure & Liability Limits

Cephill Tours & Travels acts only as an agent for airlines, hotels, transport operators, and other independent contractors. Consequently:

  • No Liability for Subcontractors: We are not liable for injury, death, damage, loss, delay, or irregularity caused by hotels, guides, transport providers, or airlines.
  • Force Majeure: We shall not be held liable or refund any amounts for delays or cancellations due to acts of God, war, civil unrest, strikes, quarantine, pandemic, government restrictions, or other conditions beyond our direct control.
  • Maximum Liability: In any event, the Company's maximum liability for any claim arising out of a tour booking is strictly limited to the total amount paid by the Client to the Company.

7. Client Conduct & Safety

While on tour, Clients must follow all instructions and safety advice provided by tour guides, rangers, and vehicle drivers. Disruption of other tour participants, refusal to follow instructions, or engaging in illegal acts (such as illegal wildlife products purchase or harassment) gives the guide the authority to terminate the Client's participation immediately.

In cases of immediate termination due to behavior, no refunds will be given, and the Client will be responsible for all their transport costs back to the departure point.

8. Governing Law & Jurisdiction

These Terms & Conditions, and any disputes or claims arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of Kenya. You agree that the courts of Kenya shall have exclusive jurisdiction to settle any disputes.
